Technologies believes in having
a clearly stated and easy to understand terms and
conditions.
Applicability:
The following terms of service apply to Blue Crescent Technologies as
well as http://www.BlueCrescentTech.com. Refusal of Service
We reserve the right to refuse or cancel service at our sole
discretion. All clients are expected to pay their invoices promptly.
Accounts that are past due for 10 business days will be subject to a 10% late
fee and may be subject to temporary deactivation. Accounts past due in excess of
60 days will be deactivated with the last 60 days
considered delinquent and due in full. All
deactivated accounts will be charged a 20% reactivation fee in addition
to their normal monthly fees. Returned or cancelled checks/credit
cards will result in immediate account deactivation
(not cancellation) and are subject to a $25.00
processing fee. Content:
All services may be used for lawful purposes only. Transmission, storage,
or presentation of any information, data or material in violation of
any United States Federal, State or City law is prohibited. This includes,
but is not limited to: copyrighted material, material we judge to be
threatening, obscene, demeaning to others, or material protected by
trade secret and other statute. The subscriber agrees to indemnify and
hold us harmless from any claims resulting from the use of the service
which damages the subscriber or any other party.
Commercial Advertising
- Email
Our servers may not be the source, intermediary, or destination address
involved in the transmission of spam, flames, or mail bombs. Your domain
may not be referenced as originator, intermediary, or reply-to address
in any of the above. Advertising sites on other servers which in turn
contain links to a domain on our servers is prohibited. We consider
spam any mass unsolicited message in the mediums of Newsgroups and Email.
If you are found to have spammed, then we will immediately, without
warning, disable your domain. In addition, we will impose a $100 penalty
for each spam policy violation. We reserve the right to refuse or cancel
service to known spammers. Lastly, we reserve the right to determine
what violates this policy. As such, any violation
will result in immediate deactivation of services without refund.
Server Abuse:
Any attempts to undermine or cause harm to a server is strictly prohibited.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Blue
Crescent Technologies
harmless from any and all demands, liabilities, losses, costs and claims,
including reasonable attorney's fees asserted against Blue Crescent
Technologies, its agents,
its customers, officers and employees, that may arise or result from
any service provided or performed or agreed to be performed or any product
sold by customer, it's agents, employees or assigns. Customer agrees
to defend, indemnify and hold harmless Blue Crescent Technologies against liabilities arising
out of; (1) any injury to person or property caused by any products
sold or otherwise distributed in connection with Blue Crescent
Technologies server; (2)
any material supplied by customer infringing or allegedly infringing
on the proprietary rights of a third party and (3) copyright infringement.
Computer Services
Terms

If you are not
100% delighted with any onsite work that we
carry out, please contact us. We will do
everything possible to resolve the issue.

Onsite repairs
are guaranteed against faulty workmanship for 30
days.

Parts used for
onsite repairs are subject to a manufacturer's
warranty. Generally this lasts for 12 months,
but please ask for the details specific to the
parts that you purchase.

Delivery charges
and/or travel charges are not refundable under
any circumstances.
Web Services and
AAU Services Terms

Upon completion of your project, we offer 30 days of free site
maintenance for minor changes and revisions. These include changing
links, contact information, and text changes of a paragraph or less.
After the initial 30 days, Blue Crescent Technologies does
offer our Web Maintenance
Services. For those comfortable with
HTML, the final project can be edited by the customer as they see fit.
Please note that errors created by a customer "self editing" their site
are NOT covered in the initial 30 days of free support.

Blue Crescent Technologies will not be responsible for any damages your business may suffer.
Blue Crescent Technologies makes no warranties of any kind, expressed or implied for services
we provide. Blue Crescent Technologies disclaims any warranty or merchantability or fitness
for a particular purpose. This includes loss of data resulting from
delays, and any and all service interruptions caused by Blue Crescent
Technologies. Blue Crescent Technologies reserves the right to change or update policies
without notice.
